ABOMA/Local 1 Janitors Labor Agreement
Approved Changes to Wages and Benefits


Following is a review of the changes in the ABOMA – Service Employees Local 1 Building Services Division of the Service Employees International Union contract. Both ABOMA and the Union have ratified the changes. These changes are effective as indicated. Contract language is being drafted, When complete printed copies of the full labor agreement will be distributed to all ABOMA Members. These terms and conditions apply only to ABOMA Member Buildings who have authorized ABOMA to include them into the bargaining unit.

ABOMA/ Local 1 Janitors Agreement – SUMMARY OF TERM AND CONDITION CHANGES EFFECTIVE DECEMBER 1, 2008

Effective Date and Duration This Agreement shall become effective December 1, 2008 and shall remain in full force and effect until November 30, 2011
The Duties of the Employees

Prohibited Work.

To collect rents, or manage the property, enter into or sign any contracts for goods and/or services without the written permission of the owner or agent of the building.
Official Union Leave All other Employees: no more than twenty two (22) work days per contract year to carry out said business.
Disability Sick Leave

After an employee has used 50% of their available, regular and accumulated sick leave disability sick leave under Section 4(a) above, the employee may then apply for use of any available disability sick leave.

Health Fund Contributions

The Employers contribution to the Health Fund shall begin on the first day of the first full month of an employee’s employment. The Employee Co-payment to the Health Fund shall begin on the first day of the first full month an Employee’s employment.

Grievance and

Arbitration Procedure

All documents including tape recordings and video files that will be used by either party at the Board of Arbitration hearing must be submitted five (5) business days in advance of the Board of Arbitration meeting to ABOMA. ABOMA upon receipt of the above documentation, tape recordings and video files will submit the information to the ABOMA Appointed Arbitrator and the Union appointed arbitrator.
Continuing Education and Training

Continuing Education Courses selected shall be subject to approval of the Employer with consideration of the recommendations of the Head Janitor. All newly hired Helper C Janitors must complete the Helper C Training Classes as established by the SEIU Local 1 Training Fund Trustees to be eligible for the full Helper C Janitor rate.

Wage Information

FOLLOWING LANGUAGE REMOVED In the event of the imposition of wage controls during the term of this Agreement, the Council and the Employer shall cooperate fully with the Union to secure such approval of the economic provisions of this Agreement as may be necessary.

Dues Deduction

COPE Dedication

COPE Deduction. The Employer agrees to deduct and transmit to SEIU Local 1, on a monthly basis, contributions to SEIU COPE deducted from the wages of employees who voluntarily authorize such deductions in writing and on the forms provided for that purpose by the Union. These transmittals shall be made based on the monthly invoice received from the Union which shall contain the names of the Employees and the amount to be deducted from the Employees wages who are participating in the voluntary COPE deduction program. No fees, penalties or late charges may be assessed without written notice.
Compensation And Hours Of Employees .An apartment allowance for Janitors employed after December 1, 2008 who reside more than 10 miles from the building does not have to be negotiated. If, at the request of the Employer, an Employee does not work a holiday that would otherwise be a scheduled work day and is called back to work on Employee’s day off within the same work week, the hours worked shall be compensated at the overtime rate provided that the Employee has worked all other scheduled hours during the work week.

Staffing

In the event a Head Janitor is unavailable for work for more than three (3) consecutive days, the employee temporarily assigned to perform the principal duties of the Head Janitor shall be paid at a rate not less than the minimum monthly wage rate established for the Head Janitor under this Agreement, commencing on the fourth day, but retroactive to the first day of such temporary assignment.
